Ishrat Jahan Encounter Case: The Story from 2004 to 2021
Ahmedabad, Gujarat: On June 15, 2004, 19-year-old Ishrat Jahan, along with Javed Sheikh alias Pranesh Pillai, Amjad Ali Rana and Zeeshan Johar, was killed in a police encounter near Kotarpur Water Works in Ahmedabad.
Ishrat Jahan was a college student from Mumbra, Mumbai. At the time, Gujarat Police claimed that the four people were linked to Lashkar-e-Taiba (LeT) and had come to Ahmedabad as part of an alleged conspiracy to assassinate then-Gujarat Chief Minister Narendra Modi.
Investigation Raises Questions
Ishrat’s family challenged the police version and sought an investigation into the circumstances of her death. A Special Investigation Team (SIT) was subsequently constituted by the Gujarat High Court.
The SIT’s investigation raised serious questions about the police account of the encounter. The matter was later investigated by the Central Bureau of Investigation (CBI).
In 2013, the CBI filed a chargesheet against seven Gujarat Police officers. The CBI alleged that Ishrat and Javed had been taken into custody before the encounter and that the subsequent shooting had been staged to make it appear as a genuine police encounter.
In 2014, the CBI also filed a supplementary chargesheet concerning four Intelligence Bureau officers. However, prosecution proceedings against the IB officers faced the issue of obtaining the required government sanction.
What Happened in Court?
The criminal proceedings against the accused police officers gradually came to an end.
In 2018, P.P. Pandey was discharged. In 2019, proceedings against D.G. Vanzara and N.K. Amin were also brought to an end.
In April 2021, an Ahmedabad Special CBI Court discharged the remaining three police officers—G.L. Singhal, Tarun Barot and Anaju Chaudhary.
The court found that the material before it did not provide sufficient grounds to establish that the encounter was fake and noted the officers’ claim that they were acting in the course of official duty.
Two Different Versions of the 2004 Encounter
The Ishrat Jahan case became controversial because two substantially different accounts emerged:
Gujarat Police’s version:
The four people were suspected terrorists who opened fire on the police and were killed in an exchange of gunfire.
CBI’s investigation:
The four had allegedly been detained before the shooting and the encounter was subsequently staged.
The later court proceedings did not result in a criminal trial against the remaining police accused; by 2021, the last three accused had also been discharged.
The Ishrat Jahan case remains a significant example of the legal and investigative controversy surrounding police encounters in India, involving competing accounts from the police, investigating agencies and the courts.
